Chrysler Minivan - Brake Shift Interlock Lawsuit

 





Amy Dawson's 4-year old daughter was run over by the family minivan in their own driveway. Ms. Dawson says she walked to the mailbox with her two daughters, thinking her Dodge minivan was safely parked. While Ms. Dawson was busy with trash bins, one daughter went back to the van, and turned the key in the ignition so she could play a CD. The minivan began to roll, and ran over the other daughter who needed 80 stitches to close her wounds.

Kim Golden was just steps away from her minivan when it began to roll with her 4-year-old daughter Lindley inside. In an attempt to bring the van to a halt, Ms. Golden was run over and killed - she was five months pregnant with twins. The brake shift interlock might have prevented this.

In 1994, Chrysler's own in house Safety Leadership Team expressly recommended that the brake shift interlock be placed in the Chrysler minivans, but this recommendation was rejected by Chrysler's management as financially imprudent.

The Branch Law Firm has filed a class action lawsuit against DaimlerChrysler on behalf of thousands of individuals in the state of New Mexico who bought new Dodge Caravans and Grand Caravans, Plymouth Voyagers and Grand Voyagers, and Chrysler Town and Countries, to force Chrysler to install the brake shift interlock on these vehicles and compensate current owners for the diminished value of there vehicle.

This suit alleges false advertising, negligence, fraudulent concealment, and several violations of the New Mexico Unfair Practices Act.
